Rape a child and no death for you!
In a 5-4 vote in the Supreme Court, the death penalty in Louisiana for the rape of a child is now off the table.
According to the court, putting a person willing to rape a child, to death is unconstitutional because it violates the Constitutions ban on cruel and unusual punishment. Could the court ask a child who was brutally raped if they were cruelly or unusually punished in any way?
“The death penalty is not a proportional punishment for the rape of a child.” - Justice Anthony Kennedy
I’m sorry, but as a parent of two children, if someone had the gall to rape one of my children, it would be a self imposed death penalty for them… it is completely proportional in my opinion.
As is typical the court was divided on the issue along liberal/conservative lines.

I only have one child who is now an adult, but the very thought that someone could rape him and not be legally held accountable for this behavior by death is not something I can fathom. To be above board, I would be prone to physical violence if someone even touched him without permission! Rape and forms of sexual abuse are almost always committed by family members. The world of Child Protective Services, Family Court, law guardians and foster care kicks in. That part of the world is supposed to be “in the best interests of the child”.
